Terms and Conditions
- Services
All Services are provided by Emma Farrar Consultancy Limited, a company registered in England & Wales under company registration number 14752641.
Emma Farrar Consultancy Limited, provides Independent Visiting Services, and Information and Support regarding:
- Local Authority Financial Assessments,
- Care Funding and assessment processes,
- Welfare Rights and
The Services shall be delivered by Emma Farrar Consultancy Ltd. Any reference to The Client within these terms, means the person with care and support needs, who may not be the Purchaser.
The Services provided under these Terms may include:
- An individual visit and assessment. This may be one single meeting or a number of meetings as is deemed necessary
- Written information and support on the relevant issues. Please note this is not to be treated as Legal advice.
- Ongoing pieces of work and timescales will be discussed with you as appropriate at the outset and reviewed periodically.
Should you have any specific requirements which are not listed above then these will need to be agreed in advance.
- Fees and Payment Terms Please note all fees are plus VAT
1 | Initial visit and booking fee | £50 plus VAT |
2 | Support to make a Property and Finance Deputyship Application online – Plus Court Application Fee of £421 unless the person who lacks capacity is on income related benefits AND capital is less than £3000. | £300 plus VAT |
3 | Support to make a Health and Welfare Deputyship Application paper – Plus Court Application Fee of £421 unless Deputy is on income related benefits AND capital is less than £3000 | £4-500 plus VAT |
4 | Drafting Lasting Powers of Attorney :- One LPA document (either Property Finances or Health and Welfare) Two LPA’s for same client (both Property & Finances and Health & Welfare) The OPG charges £82 for each LPA to be registered unless you are exempt (if on income related benefits or income of less than £12,000 per annum) | £250 plus VAT £350 plus VAT |
5 | General welfare visit, information and support – for example, visit to the client or family to discuss care and support planning, problem and solving and solution support. This could include benefits support, disability related expenditure and care fee charges and assessments, future support planning for person’s needs, signposting to services and informal advocacy. | Minimum of £50 per hour plus VAT depending on the complexity of the work and who is supporting the family. A fee estimate will be given at outset and reviewed during the work. |
6 | Travel to and from meetings. | £35 per hour travel |
7 | Cancellations/Withdrawals of instructions – We will charge for any work started according to the time spent. Appointments cancelled and not rescheduled are subject to a minimum cancellation fee of £50plus VAT. | Charge for work done, minimum of £50 plus VAT. |
This is just a sample of the work that we do. We are happy to consider a wide range of commissions covering all aspects of welfare rights, care and support needs and planning and financial assessments.
Our Fees will be sent to you upon enquiry is received along with an estimate of the likely costs.
All fees are payable on receipt of invoice and documents pay be password protected until payment is received and cleared. VAT is charged on all fees. Any additional expenses will be discussed with you and set out at the outset.
We will normally invpice on completion of the work, but we may invoice during an ongoing piece of work if the work is likely to take a number of months.
Where we have sent a quote, that quote is valid for 14 days only. After the 14 day period we may revise our quote and timescales for deliverability. Quotes for work are unique to each client and represent the time to be incurred on each matter. Quotes may be higher or lower for certain clients depending on whether there is already a pre-existing relationship which will impact the number of hours required in each circumstance and the documents or other information it becomes necessary to read and consider.
We reserve the right to password protect any documents drafted until payment has been received.
Any invoices which remain outstanding for more than 14 days after invoice, become an unpaid debt. Emma Farrar Consultancy Limited reserves their right to seek statutory interest on any unpaid debts.
- Cancellation and Postponement
Should you need to cancel or postpone your appointment for any reason, notification should be made in writing to info@emfconsultants.co.uk. Where cancellation or postponement is made with less than 72 hours before the appointment, we reserve the right to charge a cancellation fee; this will be 50% of the total cost of the services with a minimum charge of £50 plus VAT.
If in the unlikely event that we as the provider need to cancel, we will notify you as soon as is reasonably practical and any monies that have been paid to date will be returned to you via BACS transfer within 14 days of the confirmed cancellation.
- Refunds
As you are booking a specific date and time for a meeting, if you cancel the appointment with less than 72 hour’s notice, no refunds will be given.
No refunds are provided if you change you change your mind or can’t attend. However, you can postpone your appointment time provided that sufficient notice is given.
We are committed to providing you with a high-quality service that is both efficient and effective. Should you have any complaints in relation to any aspect of our service, please contact Emma Farrar on emma@emfconsultants.co.uk We agree to look into your complaint carefully and promptly and take reasonable steps to resolve it.
Refunds will be provided in accordance with your statutory rights.
- Disclaimers
It is important that you are aware that the information and support provided, is based upon the information you provide to us. If further information comes to light or information is not made available to us during the work we do for you, it may impact the accuracy and nature of the support and information we provide to you.
Delays in providing all the relevant information to us may result in delays in us preparing documents for you. It may also affect the quality of the information and support we are able to provide to you.
All the relevant information should be provided a minimum of 1 week after any meeting or one working week before any benefit or statutory deadline.
All services are performed by Emma Farrar Consultancy Limited or those working for the company.
None of the services delivered under these terms should be construed as providing medical legal or financial advice.
- Intellectual Property Rights
We retain all copyright in any documents prepared in the course of carrying our any Services on your behalf. Should you wish to use the documents for any additional purpose other than which it has been agreed, a license fee may be agreed.
- Communication
Communication with clients will be via email or telephone unless otherwise agreed in advance. Electronic communications are not totally secure and we cannot be held responsible for damage or loss caused by viruses. Our usual business hours are 9.30am until 5pm, Monday to Friday. Outside of these times responses to any communications may not be read or responded to. Please be aware that as part of the content strategy for our business, social media posts may be uploaded to social channels outside of these hours.
- Data Protection

- Confidentiality and Retention of Information
Communications between us are confidential. We will take all reasonable steps not to disclose personal information about you and your business save for in circumstances as required by law or by me to perform the internal operations of my business, such as disclosure to an accountant.

Documents and information in relation to your matters will not be held longer than required by insurance provider obligations.
- Limitation of Liability
Services are provided to you with reasonable care and skill. Foreseeable risks which could arise including changes to your welfare benefits, changes to care funding and contributions, LPA’s not being registered by the OPG due to an error or omission caused by you, or unsuccessful Court of Protection Applications.
We will take all steps to avoid such an occurrence and any liability to you is limited to the amount of any fees paid.
We do not and cannot guarantee any specific results in respect of your welfare rights and benefits, care funding and contribution assessments, LPA’s being registered and Deputyship applications being successfully granted by the Court of Protection.
There will not be no liability to you for any delay or failure to perform our obligations if the delay or failure is caused by circumstances outside our reasonable control.
Our liability is limited to the costs paid to us.
- Third Party Rights
No person other than the person provided with a copy of these Terms of Business shall be deemed to have the benefit of the services, or have any rights to enforce or rely on any of the terms.
- Applicable Law
These Terms of Business are our standard terms and conditions of business and should at all times be construed in accordance with the laws of England & Wales.
The courts of England & Wales will have exclusive jurisdiction in relation to any claim, or dispute arising out of this engagement or any matter arising from it.
